Adjustable Bed – Limited Warranty

The Limited Warranty begins on the date of purchase of a Peace Lily Adjustable Bed from Peace Lily Sleep Limited ("Peace Lily"). This Limited Warranty extends only to the original Purchaser of a new and unused Peace Lily Adjustable Bed and may not be transferred. If original proof of purchase is not provided by Purchaser, Peace Lily reserves the right to determine if the Adjustable Bed is covered by this Limited Warranty. This warranty is subject to revision and change.

The Limited Warranty begins on the date of delivery of your Peace Lily Adjustable Bed from Peace Lily Sleep Limited ("Peace Lily"). Because we at Peace Lily believe in our Peace Lily adjustable bed, and we want to provide our customers with high-quality, long-lasting products, we are hereby extending this two, five and ten year promise.

Your new Peace Lily Adjustable Bed (the “Adjustable Bed”) is covered by a 2, 5 or 10-year limited warranty (the “Adjustable Bed Warranty”). The duration of your warranty is selected at the time of purchase. Peace Lily warrants the Adjustable Bed against the defects in material and workmanship set forth below (“Defects”) for your selected warranty duration from the time your Adjustable Bed is purchased by you when the Adjustable Bed is used normally for its intended purposes together with an existing mattress.

Peace Lily warrants to the end user during the term of this Limited Warranty, Peace Lily will repair or replace any Peace Lily Adjustable Bed from the original owner should it be defective due to faulty workmanship or structural defects, at Peace Lily’s discretion and subject to the limitations and conditions described in this warranty.

In the event Peace Lily chooses to replace the Adjustable Bed, the replacement will be of the same model and size as the original Adjustable Bed purchased. In no event will a substitution model be used as a replacement except in the case of a discontinued Adjustable Bed, in this event an Adjustable Bed of like build and design, at Peace Lily's discretion will be used as a replacement for the defective Adjustable Bed.

Warranty Full Two, Five Or Ten Year (Parts, Labour & Freight):

During your warranty period and beginning from the date of purchase, the Peace Lily Adjustable Bed is warranted against non-excluded defects in Peace Lily’s workmanship or materials. During the period of your warranty and starting from the Warranty Commencement Date, Peace Lily will repair or replace (at no cost to Purchaser) any defective Adjustable Bed part, and Peace Lily will pay all Parts, authorised labour and transportation costs associated with the repair or replacement of any parts found to be defective. This replacement under warranty shall be effective only if the defective part is returned at the instruction of Peace Lily.

Limited Lifetime Warranty applies to the steel frame and mechanical base parts only.

Upon notice and from the Warranty Commencement Date through the product lifetime, Peace Lily will replace, (upon terms and conditions set forth in this paragraph), the steel and mechanical base parts found to be defective and not excluded by this warranty.

This limited lifetime warranty does not cover any electronics, electrical components, drive motors or massage motors. The purchaser is responsible to pay all service and transportation costs related to receiving and installation of the new part.

This limited lifetime warranty shall be effective only if the defective part is returned to Peace Lily.

Your Responsibilities:

The Adjustable Bed Warranty begins at the time the Adjustable Bed is purchased by you when the Adjustable Bed is used normally for its intended purposes.

A minimum of 2 able and fit adults should be used when lifting or moving the beds. It is recommended to use trolleys or other lifting/moving devices where possible.
Careless use of naked flames, cigarettes or other heat sources could set fire to this product.
Do not allow children to play on or around the adjustable bed.
Do not operate whilst any person is under the base whilst raising/ lowering or adjusting the bed.
Care should be taken so that no body parts are in or near the adjustable frame while operating.
Do not rock or tilt the frame.
Ensure the cabling of the bed is free from the mechanism.
Do not run over electric cables when moving the bed.
The Adjustable Bed needs to be positioned carefully away from power points to reduce the risk of the bed damaging power points, plugs and cabling.
Do not manipulate or conduct electrical maintenance on the motors or any of the beds, electrical components or cables.
Any electrical work must be facilitated by a qualified tradesperson.
Legs and screws should be checked for tightness regularly.
When transporting- Do not over-tighten when restraining.
Maximum recommended weight limits: 350 KG
Do not jump on or abuse the bed.
Beds should be positioned with clearance from the wall and other objects to avoid damage.
Use the controller only for adjusting the bed frame for intended use- not for entertainment.
Lubricate any moving parts, using a non-corrosive lubricant every 12 months or as required. We recommend the use of INOX.

Who This Limited Warranty Is Extended To:

This Limited Warranty extends to the initial, “original” purchaser of this product only and not to any possible future owner(s) of the product. For purposes of this Limited Warranty, an “original” purchaser is the individual or entity who purchased this mattress from Peace Lily directly or, as the case may be, from an authorised retailer, distributor or dealer.

This Adjustable Bed Warranty Does Not Cover:

This warranty does not apply:

(a) to any damage caused by Purchaser.
(b) if there has been any repair or replacement of adjustable bed base parts by an unauthorised person.
(c) if the adjustable bed base has been mishandled (whether in transit or by other means), subjected to physical or electrical abuse or misuse, or otherwise operated in any manner inconsistent with the operation and maintenance procedures outlined in the Owner’s Manual and this warranty.
(d) to damage to mattresses, fabric, cables, electrical cords or items supplied by others (contact those parties for warranty information on these items).
(e) if there has been any modification of the adjustable bed base without prior written consent by Peace Lily.
(f) to costs for unnecessary service calls, including costs for in-home service calls solely for the purpose of educating you about the adjustable bed base or finding a satisfactory power connection.
(g) fabric (including stains, soiling, burns and normal wear).
(h) items on inspection that are deemed unsanitary.
(i) failure to comply with manufacturer care and maintenance instructions.

This warranty will be void if either the recommended weight restriction is not followed (refer to the advisory section of the Owner’s Manual) or if you sell or give or transfer the bed base to another person. Any repairs to or replacement of the Peace Lily Adjustable Bed or its components under the terms of this limited warranty does not extend the applicable warranty time from the Warranty Commencement Date. The decision to repair or replace defective parts under this warranty shall be made at the sole discretion of Peace Lily.

Repair or replacement shall be the sole remedy of the Purchaser. There shall be no liability on the part of Peace Lily for any special, indirect, incidental, or consequential damages or for any other damage, claim, or loss not expressly covered by the terms of this warranty. This limited warranty does not include reimbursement for inconvenience, removal, installation, setup time, loss of use, shipping, or any other costs or expenses. Peace Lily and its service technicians will not be responsible for moving furniture or any other items not attached to the Peace Lily Adjustable Bed to perform service on the Peace Lily Adjustable Bed. It is the sole responsibility of the Purchaser to provide adequate space and accessibility to the Peace Lily Adjustable Bed. If the technician is unable to perform service due to lack of accessibility, the service call will be billed to you and the service will be rescheduled.

If the Adjustable Bed incurs a problem that is not due to a manufacturing fault, a service and repair charge will become payable by the customers to service or repair the Adjustable Bed, prior to the service call taking place. If the repair is found to be a warranty claim, then the charge will be refunded in full, after the service call within 3 - 5 business days to a nominated bank account

Peace Lily makes no other warranty whatsoever, express or implied, and all implied warranties or merchantability and fitness for a purpose are disclaimed by Peace Lily and excluded from this agreement.

How To File A Claim Under This Warranty

To file a claim under the terms of this Limited Warranty, please contact Peace Lily by emailing us at info@peacelily.co.nz. Please have your proof of purchase documentation ready and available. In the event that a warranty claim is filed and a product replacement is deemed necessary, the purchaser must surrender the original product to Peace Lily.

In the event that you, the purchaser, make a claim under this Limited Warranty, Peace Lily will assess the Adjustable Bed first, If deemed faulty, within thirty days, Peace Lily will repair or replace the Adjustable Bed, if it is found to abide by the Warranty conditions and be defective. Peace Lily will pay for shipping costs associated with the replacement product to the original purchaser.

You Must Also Provide:

Valid original proof of purchase demonstrating the date of purchase and that the claimant is the original purchaser and still has the Adjustable Bed.

You will be required to send in full-length photos which need to include a brief narrative describing the defect and how it is affecting the performance of the Adjustable Bed.

Please send all requested documentation to info@peacelily.co.nz. You are responsible for submitting your claim with sufficient supporting documentation for Peace Lily to provide a remedy if necessary. Peace Lily reserves the right, in Peace Lily's sole discretion, to require photographs, further information or descriptions, or to send a representative or independent Adjustable Bed inspector to physically inspect the Adjustable Bed prior to accepting your claim under this Adjustable Bed Warranty. Your Adjustable Bed Warranty may be voided if you refuse to cooperate with an investigation, provide adequate responses to requests, or comply with any provision of this Adjustable Bed Warranty.

The serviceable area for all Peace Lily products is addressed within all states of New Zealand only. If your Peace Lily product is located outside of New Zealand, you are responsible for any costs associated with pick-up or donation/disposal.

Disclaimer (Limitations On Liability):

To the maximum extent permitted by applicable law, Peace Lily and its authorised resellers, distributors, and/or suppliers make no representations, warranties or conditions, express or implied, beyond those set forth in this warranty and non-puffery claims in Peace Lily marketing materials. each of those parties disclaims any and all warranties or conditions, express, statutory and implied. Some jurisdictions do not allow the limitation or exclusion of certain warranties or conditions, so some of the above exclusions may not apply to you. There are no warranties that extend beyond the face of this document.

In no event will Peace Lily or its resellers, distributors, and/or suppliers be liable for any damages, including without limitation any indirect, consequential, special, incidental, or punitive damages arising out of, based on, or resulting from your or any third party’s purchase and/or use of the product, even if Peace Lily or such other party has been advised of the possibility of such damages. These limitations and exclusions apply without regard to whether the damages arise from

(1) breach of contract
(2) breach of warranty
(3) negligence
(4) any other cause of action, to the extent such exclusion and limitations are not prohibited by applicable law.

Some jurisdictions do not allow the limitation or exclusion of certain damages, warranties or conditions, so some of the above limitations may not apply to you. In no case shall Peace Lily’s liability exceed the purchase price paid for the Adjustable Bed giving rise to any such liability.

Arbitration:

If a dispute arises between you and Peace Lily arising out of or relating to this Adjustable Bed Warranty, that dispute will be resolved in accordance with the general dispute resolution provisions of the Peace Lily terms of service. The arbitration conducted pursuant to this provision will be deemed final and binding and will not be subject to appeal absent extraordinary circumstances.

As in all other dispute situations under the Peace Lily terms of service, an arbitration concerning a dispute arising out of or relating to the Adjustable Bed Warranty will not be combined with any other proceeding or arbitration against one of the parties. In addition, to the maximum extent permitted by applicable law, you will only be permitted to assert your own claim, and may not appear as a representative of the interests of any other person, entity or class of consumers (including a private attorney general or otherwise).
